These Email Sign-Up Terms ("Terms") apply whenever you submit your email address through a form on aegisnutrition.com or a linked landing page to subscribe to our mailing list ("Subscription"). By submitting the form, you agree to these Terms and confirm the consent statements below.
1. What You're Agreeing To
By submitting your email address, you expressly consent to receive marketing and promotional communications from Aegis Nutrition, which may include newsletters, coaching tips, program announcements, promotions, and event invitations, sent to the email address you provide.
You also expressly consent to Aegis Nutrition sharing your email address (and any other information submitted through the form) with its sister and affiliate companies, currently Morphogen Nutrition ("Affiliates"), so that those Affiliates may send you their own marketing and promotional communications about related products and services. This consent is separate from, and in addition to, your consent to hear from Aegis Nutrition directly. If the sign-up form presents this as a distinct checkbox or opt-in, only checking that box extends your consent to the Affiliates; otherwise, submitting the form constitutes consent to both Aegis Nutrition and the listed Affiliates contacting you, to the extent permitted by applicable law.
2. Basis for Contacting You
Depending on your location, we rely on the following legal bases to send you marketing emails:
United States (CAN-SPAM Act): we send commercial email based on the consent or business relationship you establish by submitting the form, and every message includes our identity, a valid postal address, and a functioning opt-out mechanism.
Canada (CASL): we obtain your express opt-in consent at the point of sign-up before sending commercial electronic messages, and every message identifies Aegis Nutrition and includes an unsubscribe mechanism we will honor within 10 business days.
European Union / United Kingdom (GDPR / UK GDPR): our legal basis for processing your email address for marketing is your freely given, specific, informed consent under Article 6(1)(a), which you provide by submitting the form. You may withdraw consent at any time, free of charge, without affecting the lawfulness of processing before withdrawal.
3. What Information We Collect
The sign-up form collects the information you enter, typically your name and email address, and may also record the date, source, and method of sign-up for compliance record-keeping purposes.
4. How We Use Your Information
We use the information you submit to send you the communications described in Section 1 and to manage our mailing list (for example, to honor unsubscribe requests and maintain consent records). We do not sell your personal information to third parties.
5. Sharing With Service Providers and Sister Companies
We may share your email address with third-party service providers that operate our email marketing platform (for example, an email service provider or CRM) solely to deliver these communications on our behalf.
As described in Section 1, we may also share your email address with our sister and affiliate companies, so that they can send you their own marketing communications directly. Each Affiliate that contacts you is responsible for identifying itself as the sender, honoring your unsubscribe requests for its own messages, and complying with applicable anti-spam and privacy law (including CASL's requirement that each sender be clearly identified and CAN-SPAM's requirement that each message include a valid opt-out). Unsubscribing from Aegis Nutrition's own emails does not automatically unsubscribe you from an Affiliate's separate mailing list; you may need to opt out of each list individually unless otherwise stated at the point of collection.
6. International Data Transfers
Aegis Nutrition operates in the United States, Canada, and Europe, and your information may be transferred to and processed in a country other than the one in which you reside, including the United States. Where required by the GDPR or UK GDPR, we rely on appropriate safeguards, such as Standard Contractual Clauses, for such transfers.
7. Your Rights and How to Unsubscribe
You can withdraw your consent and stop receiving marketing emails at any time by clicking the "unsubscribe" link included in every email, or by contacting us using the details in Section 10. We will process unsubscribe requests promptly and, in any event, within the timeframe required by applicable law (no later than 10 business days under CASL).
Depending on where you live, you may also have the right to:
Access, correct, or request deletion of the personal information we hold about you;
Object to or restrict our processing of your information;
Request a copy of your information in a portable format;
Lodge a complaint with your local data protection authority (for EU/UK residents) or the applicable privacy regulator (for Canadian residents, the Office of the Privacy Commissioner of Canada).
California and other U.S. state residents may have additional rights (such as the right to know, delete, or opt out of the sale or sharing of personal information) under applicable state privacy laws; as noted above, we do not sell your information.
8. Data Retention
We retain your email address and consent records for as long as you remain subscribed and for a reasonable period afterward to demonstrate compliance with applicable anti-spam and privacy laws, after which it is deleted or anonymized.
9. Age Requirement
Our mailing list is intended for individuals who are at least 16 years old (or the minimum age of consent for data processing in your jurisdiction). Please do not submit your email address through this form if you do not meet this requirement.
